Representation of Client’s at Pre-Arrest StagesThe vast majority of us are familiar with the arresting police officer’s Miranda Warning such as, “Any thing you say can and will be used against you in a court of law”. This is possibly the most important point for anyone to remember when becoming involved with the police in relation to a matter of criminal law. Regardless of your level of involvement with the crime in question, whether you are a witness or a suspect, it is essential that you contact a criminal defense lawyer immediately. When a crime has been committed there are a number of options open to the police when it comes to dealing with suspects and witnesses. They are permitted to use misinformation and deception in order to attempt to attain an admission and confession. It is common for police officers to use misleading lines of questioning which give the impression that they have proof of certain facts, or conversely that they are uncertain of some points relating to the crime. This allows them to garner additional information from suspects, or to cast doubt upon the statements of witnesses. If the police decide to bring an individual in for questioning, it is always advisable that full cooperation be supplied. However this does not mean that the individual should sacrifice any of his or her rights. Some people feel that requesting advice from criminal defense attorneys might in some way make them appear guilty or be seen as a suspicious act. However the criminal law system is complex and the police and prosecution possess a number of powers which are not commonly known or understood by the general public. For example, it is possible for witnesses to be charged as accomplices in some criminal law cases. Many people who have spoken freely to the police without the advice of criminal defense lawyers have been charged as accomplices, due to the fact that they did not intervene or report the crime. Our law firm when retained to represent the clients at their interview at the police precincts assures that minimal harm will be done to the clients, and that possible arrest will have minimal negative consequences on our clients and will be followed by a quick release form detention. Our law office continues to successfully protect its clients’ interests during all stages of the criminal procedure as indicated above. |
